DISTANCE SALES AGREEMENT

1. PARTIES

This Distance Sales Agreement (“Agreement”) is entered into electronically between the customer purchasing digital products through the Ceramixis website (“BUYER”) and the seller whose details are provided below (“SELLER”).

BUYER

The BUYER’s name, surname, email address, billing details and other order information consist of the information provided electronically during checkout.

2. SUBJECT OF THE AGREEMENT

This Agreement governs the sale and electronic delivery of the digital product or products ordered by the BUYER through the Ceramixis website and sets out the rights and obligations of the parties.

Ceramixis sells digital products only. Unless expressly stated otherwise on the relevant product page, no physical product will be shipped or delivered by mail or courier.

3. NATURE OF THE PRODUCTS

Products sold by Ceramixis may include one or more of the following digital materials, depending on the product:

  • PDF files;
  • JPEG or PNG files;
  • SVG or other digital design files;
  • printable pottery and ceramic templates;
  • slab-building templates;
  • digital instruction files; and
  • downloadable documents containing links or instructions for accessing purchased files.

The contents, file formats, dimensions and materials included with each purchase are stated on the relevant product page.

Before completing the purchase, the BUYER is responsible for reviewing the product title, images, description, included file formats and technical requirements and for confirming that the product is a digital download.

4. FORMATION OF THE AGREEMENT

An order is created when the BUYER confirms the order electronically and the payment is successfully completed.

The product name, price, applicable taxes, discounts and total payment amount are displayed to the BUYER on the order and checkout pages before payment is completed.

By completing the order, the BUYER acknowledges that the purchased product is digital and that no physical product will be shipped.

5. PRICE AND PAYMENT

The sale price is the amount displayed on the website and checkout page at the time the purchase is completed.

Payment is made electronically using one of the payment methods available on the website.

Payments may be processed by third-party payment institutions, banks, card providers or other payment service providers.

The BUYER confirms that the information provided during payment is accurate and that the BUYER owns or is authorized to use the selected payment method.

6. DIGITAL DELIVERY

Purchased products are not physically shipped.

Following successful payment, digital products may be delivered electronically through one or more of the following methods:

  • an immediate download link;
  • the order confirmation or thank-you page;
  • email; or
  • a downloadable PDF containing a link or instructions for accessing larger file packages.

Most products are made available shortly after payment has been successfully completed.

The BUYER is responsible for providing a valid and accessible email address, reviewing the order confirmation and download instructions, downloading the files and securely storing a copy of the purchased files.

If the BUYER cannot access the files due to a technical problem, the BUYER may contact the SELLER at info@ceramixis.com.

7. RIGHT OF WITHDRAWAL AND DIGITAL PRODUCTS

Products sold by Ceramixis are digital contents delivered electronically.

Under applicable consumer legislation, contracts concerning services performed immediately in an electronic environment or intangible goods delivered immediately to the consumer may be excluded from the statutory right of withdrawal.

Accordingly, once digital delivery has begun or the purchased files have been made available for download, accessed or downloaded, the order is generally not eligible for cancellation, exchange or refund, except where mandatory consumer legislation requires otherwise.

By completing the purchase, the BUYER acknowledges and expressly agrees that:

  • the purchased product is digital;
  • no physical product will be shipped;
  • electronic delivery may begin immediately after successful payment; and
  • where permitted by applicable law, the right of withdrawal may end once immediate digital delivery or access begins.

The BUYER may contact the SELLER in the following circumstances:

  • the wrong file was delivered;
  • a file stated in the product description is missing;
  • the delivered file is technically corrupted or cannot be downloaded due to a verified technical problem;
  • the delivered product is materially different from its description; or
  • the same order was charged more than once because of a technical error.

Depending on the circumstances, the SELLER may provide the correct or missing file, restore download access, provide technical assistance, replace a defective file or offer another solution required under applicable law.

Nothing in this Agreement limits any mandatory consumer rights that cannot legally be excluded or waived.

8. CANCELLATIONS AND REFUNDS

Due to the nature of digital products, after the digital content has been delivered or made available for access, and unless mandatory law requires otherwise:

  • there is no physical product to return;
  • digital files cannot be physically returned;
  • refunds or exchanges are not generally provided for change-of-mind purchases;
  • refunds are not generally provided because the product description was not read before purchase;
  • an accidental purchase made under the expectation of receiving a physical product does not automatically create a right to a refund;
  • refunds are not generally provided because the BUYER lacks the required printer, software, pottery materials, tools, kiln or experience; and
  • refunds are not generally provided for results affected by printer settings, paper size, clay type, shrinkage rate, construction technique, drying, firing or glazing.

Refund requests involving a verified file or order problem will be reviewed individually.

9. INTELLECTUAL PROPERTY AND LICENSE

All copyrights and other intellectual property rights relating to the purchased digital products remain the property of Ceramixis or the relevant rights holder.

Purchasing a digital product does not transfer ownership of the copyright or intellectual property to the BUYER.

Unless otherwise stated in the product description or a separate license, the purchased digital files are licensed for personal use.

Unless expressly permitted, the BUYER may not:

  • resell the digital files;
  • share or distribute the files;
  • publish or provide the files free of charge;
  • sell the files as part of another digital product;
  • upload the files to file-sharing platforms;
  • copy or redistribute the instructions or templates; or
  • claim the files or designs as their own original digital work.

Any additional commercial-use permission stated on an individual product page will apply only to that specific product and subject to the conditions stated there.

10. USE OF DIGITAL PRODUCTS

The final results produced using Ceramixis pottery and craft templates may vary depending on factors including:

  • clay type;
  • material thickness;
  • clay shrinkage rate;
  • printer and scaling settings;
  • paper size;
  • construction technique;
  • drying conditions;
  • firing temperature and process; and
  • glaze selection and application.

The BUYER is responsible for determining whether the selected materials, dimensions, production methods and final product are suitable for the BUYER’s intended project and use.

Ceramixis does not guarantee that every completed physical project will have exactly the same measurements or appearance as examples shown in product photographs or digital illustrations.

11. PERSONAL DATA

The BUYER’s personal data is processed in accordance with applicable legislation and the Ceramixis Privacy Policy.

For the operation of the store, payment processing and electronic delivery, certain information may also be processed by Shopify, payment service providers and other third-party service providers necessary to complete and support the transaction.

12. APPLICABLE LAW AND DISPUTES

This Agreement is governed by the laws of the Republic of Türkiye.

Where the BUYER’s country of residence provides mandatory consumer protection rights that cannot legally be excluded by contract, those rights remain unaffected.

Depending on the nature and value of the dispute, the BUYER may apply to the competent consumer arbitration committee, consumer court, mandatory mediation process or other competent authority in accordance with applicable legislation.

Before initiating formal proceedings, the BUYER may contact the SELLER at info@ceramixis.com to request assistance or attempt to resolve the matter.

13. ENTRY INTO FORCE

By completing an order through the website, the BUYER acknowledges that:

  • the purchased product is a digital product;
  • no physical product will be shipped;
  • the product description, included files and price were available for review before purchase;
  • the total payment amount was displayed before payment;
  • the BUYER had the opportunity to review the relevant store policies; and
  • electronic delivery may begin immediately following successful payment.

This Agreement enters into force when the order and payment are completed electronically.

The order confirmation, payment records and information provided during checkout form an integral part of the transaction.
