Welcome to Ceramixis.

The terms “we,” “us,” and “our” refer to Ceramixis. Ceramixis operates this website and online store and provides digital products, information, content, features, tools, and related services to you (collectively, the “Services”).

Our store is hosted and powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced in these Terms, explain the rights and responsibilities that apply when you access or use our website, purchase our digital products, or otherwise interact with our Services.

By visiting, using, or purchasing from our website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not access or use the Services.


SECTION 1 – ELIGIBILITY AND ACCOUNT INFORMATION

By using the Services, you represent that you are at least the age of majority in your country, state, or province of residence, or that you have obtained any legally required permission to use the Services.

You may be required to provide certain information when using our website or making a purchase, including your name, email address, billing information, and payment information.

You agree that all information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity conducted through your account.

You may not transfer, sell, assign, or license your customer account to another person.


SECTION 2 – DIGITAL PRODUCTS

Ceramixis sells digital products only.

No physical item will be shipped unless a particular product listing expressly states otherwise.

Our digital products may include, depending on the specific listing:

  • PDF files
  • JPEG or PNG files
  • SVG or other digital design files
  • Printable pottery templates
  • Ceramic and slab-building templates
  • Instructions or supporting digital documents
  • Download-access documents or links

The exact files included with each purchase are described in the relevant product listing.

You are responsible for carefully reviewing the product description, file types, dimensions, included materials, and software or printing requirements before completing your purchase.

We make reasonable efforts to accurately display and describe our products. However, colors, dimensions displayed on screen, and the appearance of digital content may vary depending on your device, monitor settings, printer settings, materials, clay body, construction technique, firing process, glaze, shrinkage rate, and other factors outside our control.

Finished ceramic results may therefore differ from photographs, examples, mockups, or other visual references shown on our website.


SECTION 3 – ORDERS AND ACCEPTANCE

By placing an order, you are making an offer to purchase the selected digital product.

An order is not considered accepted until payment has been successfully processed and the order has been confirmed.

Please carefully review your order before completing your purchase.

Because our products are digital and may be made available immediately after payment, an order may not be eligible for cancellation after access to the digital content has been provided, except where required by applicable law.

We reserve the right to reject, cancel, or limit an order where reasonably necessary, including in cases of:

  • suspected fraud;
  • unauthorized payment activity;
  • pricing or technical errors;
  • misuse of our Services;
  • violation of these Terms; or
  • other legitimate business or legal reasons.

If we cancel an order after payment has been collected and no valid digital product has been supplied, we will provide an appropriate refund where required.


SECTION 4 – DIGITAL DELIVERY

All products sold by Ceramixis are delivered electronically.

No physical shipping or postal delivery is provided for digital products.

After successful payment, digital files may be provided through one or more of the following methods:

  • an immediate download link;
  • an order confirmation page;
  • a customer account;
  • email delivery;
  • a downloadable PDF containing access instructions or a link to the purchased files.

Delivery method may vary depending on the product and the number or size of files included.

You are responsible for:

  • providing a valid and accessible email address;
  • downloading and securely storing your purchased files;
  • ensuring that your device and software can open the file formats described in the product listing;
  • checking your spam or junk folder when relevant.

We will make reasonable efforts to help you access the files included in your purchase.


SECTION 5 – REFUNDS, CANCELLATIONS, AND DIGITAL CONTENT

Because Ceramixis sells digital products that may be supplied or made accessible immediately after purchase, all sales are generally final once access to the digital content has been provided, except where a refund, cancellation, repair, replacement, or other remedy is required by applicable law.

We generally do not accept returns, exchanges, or cancellations simply because:

  • you changed your mind;
  • you purchased the wrong product;
  • you did not read the product description;
  • you expected a physical product;
  • you no longer need the file;
  • you lack the required software, printer, materials, equipment, or skill level.

Please contact us if:

  • you received the wrong file;
  • a file included in the product description is missing;
  • the supplied file is corrupted or cannot be opened because of a problem with the file itself;
  • you were accidentally charged more than once for the same order.

We will review the issue and, where appropriate, provide technical assistance, a replacement or corrected file, or another remedy required by applicable law.

Where permitted by applicable consumer law, by requesting or receiving immediate access to digital content, you acknowledge that your statutory right to cancel or withdraw may end once delivery or access to the digital content begins.

Nothing in these Terms or our Refund Policy excludes, restricts, or limits any mandatory consumer rights that cannot legally be excluded.

SECTION 6 – LICENSE AND PERMITTED USE

Unless otherwise expressly stated in the relevant product listing or in a separate written license, all digital products purchased from Ceramixis are licensed for personal use only.

Your purchase grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the purchased files for your own personal projects.

The purchase of a digital product does not transfer copyright, ownership, trademark rights, or other intellectual property rights to you.

You may use the purchased template to create your own personal handmade projects.

Unless Ceramixis has given you express written permission, you may not:

  • resell the digital file;
  • redistribute the digital file;
  • share the digital file with another person;
  • upload the file to file-sharing websites, groups, forums, social media platforms, marketplaces, cloud libraries, or public databases;
  • give the file away for free;
  • copy and sell the template itself;
  • modify the file for the purpose of reselling or redistributing the modified version;
  • convert the file into another digital format for resale or redistribution;
  • include the file in another digital product, bundle, course, membership, subscription, or template collection;
  • claim the design or digital file as your own original work;
  • use our product images, graphics, listing photographs, videos, descriptions, or branding without permission.

Purchasing a file does not grant permission to distribute the file to students, workshop participants, customers, employees, members, or other third parties.

Any commercial-use permission must be expressly stated in the applicable product listing or granted separately in writing by Ceramixis.


SECTION 7 – INTELLECTUAL PROPERTY

The Services and all materials made available through them, including but not limited to:

  • digital templates;
  • designs;
  • drawings;
  • graphics;
  • photographs;
  • videos;
  • product images;
  • logos;
  • branding;
  • website text;
  • product descriptions;
  • instructions;
  • downloadable files; and
  • the selection and arrangement of such materials

are owned by or licensed to Ceramixis and are protected by applicable copyright, trademark, and other intellectual property laws.

Except for the limited license expressly granted to you under these Terms, no right, title, or interest in our intellectual property is transferred to you.

Unauthorized reproduction, resale, distribution, publication, sharing, or commercial exploitation of our digital products may result in the suspension of access to our Services and may also result in appropriate legal action.

All rights not expressly granted are reserved by Ceramixis.


SECTION 8 – PRICES, TAXES, AND PAYMENT

Prices may be changed at any time without prior notice.

The price charged for a product will be the price displayed at the time the order is placed, subject to correction of obvious pricing or technical errors.

Any applicable taxes or additional charges will be displayed where required and where technically applicable during the purchase process.

You agree to provide current, complete, and accurate payment and billing information.

You represent that:

  • you are authorized to use the payment method provided;
  • the information you provide is accurate; and
  • you are responsible for all valid charges associated with your purchase.

Payment processing may be provided by third-party payment service providers. Your use of those payment services may also be subject to the applicable provider's terms and privacy policies.


SECTION 9 – POTTERY, CERAMIC, AND CRAFT RESULTS

Ceramixis provides digital templates and design resources.

Unless expressly stated otherwise, we do not provide professional engineering, structural, medical, food-safety, kiln-safety, or other regulated professional advice.

The final result of a ceramic or craft project may depend on numerous factors outside our control, including:

  • clay type;
  • clay thickness;
  • shrinkage rate;
  • construction method;
  • drying process;
  • firing temperature;
  • kiln conditions;
  • glaze application;
  • material compatibility;
  • printer scaling;
  • user technique and experience.

You are responsible for determining whether a project, material, glaze, firing method, or finished object is suitable and safe for your intended use.

For functional ceramics, including items intended for food or drink use, you are responsible for using appropriate materials, glazes, firing methods, and safety procedures.


SECTION 10 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, applications, payment providers, download systems, integrations, or other services operated by third parties.

Such services may be provided on an “as available” basis and may be subject to the third party's own terms and privacy practices.

We are not responsible for third-party websites, services, applications, or tools that we do not own or control.

Your use of third-party services is at your own discretion and may be subject to the terms of the relevant third-party provider.


SECTION 11 – THIRD-PARTY LINKS

Our Services may contain links to third-party websites or services.

We are not responsible for examining or evaluating the content, accuracy, availability, security, or policies of third-party websites.

Your use of third-party websites is at your own risk.

Any questions, claims, or concerns regarding third-party products or services should be directed to the relevant third party.


SECTION 12 – SHOPIFY

Ceramixis uses Shopify to help provide and operate the Services.

However, purchases made through our store are transactions between you and Ceramixis.

Shopify is not the seller of Ceramixis digital products and is not responsible for the products purchased from Ceramixis, except to the extent expressly required by applicable law or Shopify's own separate obligations.


SECTION 13 – PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, certain personal information may also be processed by Shopify and other service providers that help us operate the store, process payments, provide digital downloads, communicate with customers, prevent fraud, and perform related services.

SECTION 14 – FEEDBACK, REVIEWS, AND USER CONTENT

If you voluntarily submit reviews, photographs, comments, suggestions, feedback, or other content to us, you represent that you have the right to submit that content and that it does not infringe the rights of another person.

  • every file will be compatible with every device, application, printer, or software version;
  • the Services will always be uninterrupted or error-free;
  • a finished ceramic or craft object will be suitable for every purpose.

Nothing in these Terms excludes any warranty, guarantee, or legal right that cannot lawfully be excluded.


SECTION 18 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Ceramixis will not be liable for indirect, incidental, special, consequential, or similar losses arising from the use or inability to use the Services or digital products.

This may include, where legally permitted, loss of profits, loss of revenue, loss of data, loss of opportunity, or indirect replacement costs.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Your mandatory statutory rights remain unaffected.


SECTION 19 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Ceramixis harmless from third-party claims, damages, liabilities, and reasonable costs arising directly from:

  • your unlawful use of the Services;
  • your material violation of these Terms;
  • your infringement of another person's intellectual property or other legal rights.

This section does not apply to the extent that a claim results from our own unlawful conduct or where such an obligation cannot legally be imposed on a consumer.

You may stop using the Services at any time.

We may suspend or terminate access to the Services where reasonably necessary, including for serious or repeated violations of these Terms, fraud, unlawful activity, abuse, or security risks.

Termination does not affect rights or obligations that arose before termination.

Sections relating to intellectual property, licensing, payment obligations, liability, and other provisions that by their nature should survive termination will continue to apply.


SECTION 21 – SEVERABILITY

If any provision of these Terms is found by a competent authority to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.

The remaining provisions will continue in effect.


SECTION 22 – ENTIRE AGREEMENT

These Terms, together with the policies and notices published on our website, constitute the agreement between you and Ceramixis concerning your use of the Services and purchases from our store.

Failure by us to enforce a provision of these Terms on one occasion does not constitute a permanent waiver of that provision.


SECTION 23 – GOVERNING LAW AND MANDATORY CONSUMER RIGHTS

These Terms and the Services provided by Ceramixis are governed by the laws of the Republic of Türkiye, subject to any mandatory consumer protection laws that apply to you and cannot legally be excluded or limited by contract.

Nothing in these Terms deprives a consumer of any mandatory rights or protections available under the laws applicable to their purchase.

Any dispute will be handled by the courts or competent authorities having jurisdiction under applicable law.

We may update these Terms from time to time to reflect changes to:

  • technical requirements; or
  • other operational needs.
